Terms of service

Terms of Service

These terms cover Miss No More, operated by Apex Arbitrage Solutions LLC (“we,” “us”). By using the service, calling a shop that uses it, or agreeing to receive texts from it, you agree to these terms.

Shops that use Miss No More sign a separate client services agreement, which governs their service.

The service

Miss No More provides missed-call recovery, AI phone answering, and appointment booking for local service businesses such as plumbing and HVAC shops. When a shop can’t pick up, our automated AI assistant answers or follows up, gathers the details of the job, offers open times, and books the visit on the shop’s calendar. The shop, not us, performs the actual service work.

Features vary by shop. Unless a shop has turned a feature on, the assistant doesn’t send you a text, email, or calendar event; it reads your booking back to you on the call. The assistant uses AI and can mishear or make mistakes, so listen to the details it reads back and contact the shop if anything is wrong.

Not an emergency service

Miss No More is not an emergency service and is not a substitute for 911. If you’re facing a danger to life or property, such as a fire, a gas smell, or flooding near electrical, hang up and call 911 or your utility.

Some shops have the assistant flag urgent calls, alert the owner, or try to transfer you to their on-call contact, but alerts and transfers can fail or be delayed. We don’t promise that every call reaches a live person. Each shop is responsible for how it handles emergencies.

SMS program terms

  • When texts start: only after phone carriers approve the shop’s business-texting registration, filed in the shop’s own legal business name. Approval usually takes days to weeks and is outside our control, so no start date is promised. Until then, no texts are sent.
  • Texts after a missed call: If you call a shop and the call is missed, the shop may send you one text replying to your call. Reply STOP to opt out anytime. We never send marketing texts without your consent.
  • What we send: appointment confirmations and service messages only.
  • Frequency: message frequency varies.
  • Cost: message and data rates may apply.
  • Opt out: reply STOP at any time. You’ll get one message confirming you’ve opted out.
  • Help: reply HELP, or email support@missnomore.co.
  • Carriers are not liable for delayed or undelivered messages.

See our Privacy Policy for how we handle your number. Mobile numbers and SMS opt-in consent are not shared with or sold to third parties or affiliates for marketing or promotional purposes.

No guarantee of results

We don’t guarantee any number of calls answered, jobs booked, or revenue recovered. Any estimates, including those on our website, are illustrations, not promises.

Acceptable use

Don’t use the service to harass anyone, give false information, or break the law.

Limitation of liability

The service is provided “as is.” To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, or for lost profits or missed jobs. Our total liability for any claim is limited to the total fees you paid us in the 3 months before the claim. The shop is responsible for the service work it performs and for how it handles emergencies.

Governing law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules.

Changes to these terms

We may update these terms. When we do, we’ll change the date at the top. If you keep using the service after that, you accept the updated terms.
